This AMA site explains HIPAA violations in official terms. The defination of “knowing” what kind of disclosure constitutues a crime was interesting:

Knowingly

The DOJ interpreted the “knowingly” element of the HIPAA statute for criminal liability as requiring only knowledge of the actions that constitute an offense. Specific knowledge of an action being in violation of the HIPAA statute is not required.

It was only this week that two teens were arrested in the theft of a VA laptop that contained tens of thousands of sensitive information on veterans but not soon after it is now reported that another laptop is missing with more than 30,000 veteran information.

A worker reported the laptop lost Thursday and an investigation is underway to figure out how and why it happened.

A big hint would be that employees are allowed to have this amount of information on laptops that they take home with them.
